Forest Operations Notification: Interpretation of signature requirements.

All timber harvesting operations where the intent is to harvest forest products, construct land management roads, and/or establish water crossings requires the filing of a Forest Operations Notification (FON) form. This applies to any timber harvesting when the primary purpose is to sell the timber or the timber is processed into forest products for sale (Maine Forest Service Rule - Chapter 26: Section 1(B)(1).

Section 1 of the FON form is the section where the information for the landowner, designated agent, harvester and licensed forester can be entered.  All parties named by a landowner or designated agent on a notification (landowner, designated agent, forester, and harvester) must sign the notification. The landowner and harvester sections are required information segments of this page (designated with an asterisk as required information); they must be completed and have a signature of that individual for the FON to be accepted by the Maine Forest Service (MFS).  A notification submitted without one or more signatures of named parties will be considered incomplete.

12 M.R.S. §8883-b, sub-§2(A) requires that the notification include: “the name, address and phone number of the landowner, any designated agent and, if known, any harvester or harvesters;” and, sub-§2(I) “the signatures of the harvester when listed on the form in accordance with paragraph A …”

Any FON that does not contain the required information and/or signatures will be rejected as incomplete.  The FON can be updated by either the landowner or designated agent in writing (must be signed and dated) and sent to the address for FON filings. The FON can also be amended by completing and mailing the MFS Amendment to Forest Operations Notification form (see the MFS web site http://www.maine.gov/dacf/mfs/publications/forms/FONSAmendmentForm.pdf).

Example:  If a FON is filed before a harvester has been chosen, and the harvester section is left blank, the FON will be considered incomplete.  The harvester information and signature must be provided to the MFS by amendment prior to the commencement of the harvesting operation.  The amendment must be received and accepted by the MFS before the FON can be complete (valid).  Harvests without a completed FON are subject to legal penalty.
