PROBABLE CAUSE FINDINGS

Landlord Charged With Denying Reasonable Accommodation

Complainant owned a pit bull dog as an emotional support animal for use during specific situations. On or about February 28, 2015, Complainant and her husband visited the Respondent and inquired about a four bedroom home for rent in Jeffersonville, Indiana. Respondent asked if Complainant was a pet owner and evidence shows that the tenant responded, “yes, a dog,” at which point Respondent stated that “I don’t take dogs because they mark their territory by wetting on the carpets.” The next day Respondent called Complainant and inquired about the dog’s breed... more

Notice of Findings Issued Against Home Goods
A Home Goods store in Brownsburg, Indiana hired Complainant as an hourly production employee on or about June 30, 2014. Home Goods’ employment application required him to disclose whether he had been convicted of a crime in the past seven years. While Complainant answered no, he admits that he had several felony convictions from 2002 and 2005, outside of the requested timeframe.  Home Goods hired Complainant and he performed his duties without issue. Several months later, on or about November 6, 2014, Complainant’s supervisor handed him a copy of his background check and said that he was terminated because of his felony convictions... more

Probable Cause Findings Issued Against AVI Foodsystems
AVI Food Systems hired Complainant as a cashier in March 2014. Complainant had a medical condition that impaired her ability to stoop, bend, twist, or lift items in excess of ten pounds. Complainant alleges that AVI Food Systems was aware of her limitations and agreed to accommodate her restrictions; yet, during the course of her tenure with Respondent, she was transferred to the position of dishwasher where she was required to lift heavy pans weighing in excess of 20 pounds... more

AVI Foodsystems Charged With Disability Discrimination
AVI Food Systems hired Complainant as a delivery driver on or about March 2012. Complainant had a medical condition that prevented him from lifting more than 20 pounds. Complainant states that he alerted AVI Food Systems of his restrictions and refused to perform such tasks because of his impairment. Complainant contends that he was then terminated, without the required interactive dialogue process, because of his disability. Complainant also asserts that similarly-situated African-Americans and women were treated more favorably when they refused to perform various duties associated with their employment... more
